The following Terms and Conditions control your participation in the UAB TouchPoints II program. You agree that you have read and understand this Agreement ("Agreement") and that your participant status in the UAB TouchPoints II program (the "Program") shall be subject to the following Terms and Conditions between you (the "Participant") and University Hospital ("UAB").
Participants registering in the Program will earn 10,000 "TouchPoints" for each successful whole blood donation or 20,000 for each platelet or ALYX donation made in the University Hospital Donation Center or during a University Hospital Blood Drive. Clinical guidelines will determine how often blood donations can take place. Blood donations made at other sites or during other blood drives will not be eligible for earning TouchPoints. TouchPoints will expire at the end of the 3rd calendar year following the calendar year the points are earned (i.e., TouchPoints earned after May 2010 will can be redeemed through December 2013).
After 4 successful donations, earning a total of 40,000 TouchPoints, participants may redeem a $100 Marriott card or a $100 Discover card. TouchPoints must be redeemed by the end of the TouchPoints II program in December 2013.
Terms of Participation
Participants must meet the eligibility requirements for blood or platelet donation as set forth in the University Hospital Donation Center.
Corporations or other business entities are not eligible to become Participants of the Program. A participant must be a human.
Participants must provide UAB with accurate, complete and updated registration information, including an accurate name, address and email address.
Participants may not (i) activate or use more than one Participant account; (ii) select or use a username of another person; (iii) use a name subject to rights of another person without authorization from that person; (iv) use a false or misleading name, address, or email address to activate or use a Participant account; (v) or present or supply false or misleading information to UAB.
UAB reserves the right to perform weekly audits of Participant activity to assure compliance with this policy. Upon any discrepancy, UAB may require Participant to provide two (2) forms of proof in order to verify the accuracy of the account information provided by the participant at the time of registration or anytime thereafter.
UAB has the right, in its sole discretion, to suspend or cancel, at any time and for any or no reason, a Participant from the Program. All TouchPoints may be cancelled in UAB's sole discretion.
Participant agrees not to abuse his or her participant privileges by acting in a manner inconsistent with this Agreement. Participant agrees not to attempt to earn TouchPoints through other than legitimate channels authorized by UAB. Participant agrees not to participate in any fraudulent behavior of any kind.
Participant understands and agrees disabling and termination of participant status will result in Participant's inability to redeem and/or earn TouchPoints. Participant understands and agrees termination of participant status will result in the cancellation of all of Participant's TouchPoints.
UAB shall be the sole determiner in cases of suspected abuse, fraud, or violation of its rules. Any decision UAB makes relating to the cancellation of TouchPoints and the termination of participant status shall be final and binding.
UAB reserves the right to limit participant enrollment at any time at its sole and absolute discretion.
Participant's discontinued participation in the Program or failure to notify UAB of any address (mail or email) or profile changes may result in the termination of Participant's status and and forfeiture of Participant's unredeemed TouchPoints.
Participant shall comply with all laws, rules, and regulations that are applicable to Participant. Participant acknowledges that Participant may only participate in the Program if and to the extent that such participation is permitted by such laws, rules, and regulations.
UAB may refuse to enroll Participant, or to restrict, modify, or terminate Participant's participation in the Program, without liability to Participant or any other party, if Participant violates any law, rule, or regulation, or if Participant's participation in the Program could violate any law, rule, or regulation.
AT ANY TIME EITHER PARTICIPANT OR UAB MAY TERMINATE PARTICIPANT''S STATUS WITH OR WITHOUT CAUSE. PARTICIPANT'S RIGHT TO USE PARTICIPANT''S STATUS IMMEDIATELY CEASES UPON TERMINATION AND PARTICIPANT''S UNREDEEMED TOUCHPOINTS SHALL BE CANCELLED.
If Participant objects to any of the Terms and Conditions of this Agreement, or any subsequent modifications to this agreement, or becomes dissatisfied with the Program, Participant's only recourse is to immediately discontinue participation in the Program and properly terminate his or her participant status.
TouchPoints may be redeemed only for items offered through the UAB website at the time of redemption. Once used to claim an item, TouchPoints will not be reinstated to the Participant's account under any circumstance.
TouchPoints have no cash value; TouchPoints are not transferable in any instance or circumstance. TouchPoints may not be bartered or sold. UAB reserves the right to change at any time without prior notification of the Participant, the number of TouchPoints required to achieve any of its rewards, the actual rewards themselves, or any other aspect of the reward program. Certain restrictions may apply to certain rewards.
Participant must accrue the required amount of TouchPoints before he or she can be eligible to redeem any reward offered on the UAB web site. TouchPoints will be subtracted from the Participant's account as soon as the TouchPoints are redeemed. Once redeemed, TouchPoints will not be reinstated to the Participant's account. For details on redemption levels, please refer to the website.
UAB reserves the right to limit the redemption of a specific reward and limit the number of rewards available. Redemption may be modified by UAB at its sole discretion at any time. Participant agrees to provide accurate and up to date information at the time of redemption of the reward. If Participant fails to provide accurate information to UAB, Participant may be terminated from the UAB program. If Participant redeems TouchPoints by, through or as a result of fraudulent, illegitimate or illegal means or activity, Participant will be fully liable for all costs incurred as a result of Participant's redemption.
Unredeemed TouchPoints will expire on December 31, 2013.

The goal of UAB is to provide means for Participants to accumulate TouchPoints that may be redeemed for rewards while protecting the privacy of the Participants. As such, privacy is at the core of UAB.
All information collected as a result of your participant status with UAB will be controlled by UAB. We do not give, sell, rent, share, show or trade any identifiable personal information regarding our participants to any third party, with the exception of third-party contractors and service providers who work with UAB to provide the rewards and other services, and who are strictly prohibited from later use of the information that they may have access to.
Information We Collect and Our Use of the Information
In our online registration form, we require you to provide us with your e-mail address, mailing address, zip code, and a password. We will process this information to administer your Participant status and to administer the Hospital Blood Donation Program. The information will not be used for any purpose unrelated to administration of the Hospital's Blood Donation Program and the TouchPoints II Program.
This site has security measures in place to protect the loss, misuse, and alteration of the information under our control. We use industry standard procedures and processes to safeguard the confidentiality of your identifiable personal information, such as firewalls, monitoring technology, and adaptive analysis of network traffic to track abuse of our network and its data. Unfortunately, when you submit information about yourself to UAB over the Internet the information may travel over many systems that are not under the control of UAB. One easy and important way to protect your personal information is to guard your account password and close your browser windows when you step away from your computer
Contacting the Web Site
We may disclose personal information when required by law or in the good-faith belief that such action is necessary in order to conform to the edicts of the law or comply with a legal process served on our Web site.
Changes to this Agreement
All terms of this agreement are subject to change at any time without prior notification or approval of the Participants. If a Participant objects to any of the Terms and Conditions of this Agreement, or any subsequent modifications of this agreement, or becomes dissatisfied with the Program, the Participant's only recourse is to immediately discontinue participation in the Program and terminate participant status. Participant's continued status and use of the Program after any changes have been made shall constitute acceptance of such changes by the Participant.
Disclaimer of Warranties
PARTICIPANT EXPRESSLY AGREES THAT THE USE OF THE PROGRAM IS AT THE PARTICIPANT'S SOLE RISK. THE PROGRAM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW, UAB EXPRESSLY DISCLAIMS ALL CONDITIONS AND WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED BY LAW, CUSTOM OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. UAB MAKES NO WARRANTIES OF ANY KIND WITH REGARD TO ANY PRODUCTS, SERVICES OR REWARDS OBTAINED BY PARTICIPANTS.
UAB MAKES NO WARRANTIES OF ANY KIND THAT THE PROGRAM WILL MEET PARTICIPANT REQUIREMENTS. UAB MAKES NO WARRANTIES OF ANY KIND AS TO THE RESULTS THAT MAY BE OBTAINED THROUGH THE PROGRAM OR THAT THE PROGRAM WILL BE UNINTERRRUPTED, TIMELY AND/OR ERROR FREE. UAB MAKES NO WARRANTIES OF ANY KIND AS TO THE ACCURACY OF THE INFORMATION OBTAINED THROUGH THE PROGRAM.
LIMITATION OF LIABILITY
No information of any kind obtained by a Participant from or through the Program shall create any warranty not expressly made herein.
UAB NOR ANY OF ITS PARENTS, PARTICIPANTS, SUBSIDIARIES, SERVICE PROVIDERS, LICENSORS, OFFICERS, DIRECTORS OR EMPLOYEES SHALL NOT BE LIABLE FOR ANY DAMAGES, WHETHER DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO THIS AGREEMENT, RELATING TO THE PARTICIPATION OR INABILITY TO PARTICIPATE IN THE PROGRAM OR RELIANCE ON OR USE OF INFORMATION OR RESULTING FROM ANY GOODS OR SERVICES RECEIVED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH THE SERVICE, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLE, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES; SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
Participant acknowledges and agrees that UAB neither endorses the contents of messages, nor assumes responsibility or liability for the accuracy of material contained therein, or any infringement of third party intellectual property rights arising therefrom, or any fraud or other crime facilitated thereby.
UAB is not responsible, and assumes no liability for changes or discontinuances of reward items, which may affect the accrual of TouchPoints. In no event shall UAB's liability, either jointly or severally, exceed $100.
Participant agrees to indemnify and hold UAB, it affiliates, its officers, its employees, and its consultants harmless from any claim, demand, expense or damage, including reasonable attorneys' fees relating to use of the Program or violation of this Agreement.
This agreement shall be governed by and construed in accordance with the laws of the State of Alabama. If any provision of this agreement is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent possible, and the other provisions contained herein will remain in full force and effect.
Notices given by UAB, to you will be given to participant by email, regular mail or by general posting on the web site.
